In Michigan, adoptions are governed by the Adoption Code which was originally passed in to law in 1938. The law was designed to safeguard and promote the best interests of the child or adoptee and to protect the rights of all parties involved in the adoption. The law was also indented to settle conflicts that might arise between the rights of the parties in the adoption in favor of the rights of the child or adoptee. The law has been revised since then, but its purpose has remained the same; to provide for the best interests of the child or adoptee.

In order for a child to be adopted, one or more of the child's existing legal guardians must relinquish their rights. Since the Fourteenth Amendment of the United States Constitution protects the rights of a parent, releasing a child from those rights can be a complex process.

The court will conduct an investigation to see if the adopting parents are fit to adopt the child. Michigan law specifically prohibits some people from being eligible for adoption. Some criminal conduct can make a person ineligible.
